Unseen Pass is a street-legal side-by-side (SXS) rental company located in the mountains in Ashe County, NC in the small town of West Jefferson, NC. West Jefferson is 30 minutes north of Boone, NC.
In case you are unfamiliar with my story, I started Unseen Pass Inc. in June of 2020, which was a street-legal SXS rental company based out of West Jefferson, NC (Ashe County, NC).
Effective October 1, 2021; NCGS 20-4.01 has been amended by changing some specifications to the modified utility vehicle definition that allows these vehicles to be titled and registered in North Carolina.

Effective October 1, 2021; NCGS 20-4.01 has been amended by changing some specifications to the modified utility vehicle definition that allows these vehicles to be titled and registered in North Carolina. Please see attached SB241 for specifics.
The modified utility vehicle is motor vehicle that is manufactured OR upfitted by a licensed manufacturer, dealer or person or business otherwise engaged in vehicle manufacturing or modification for off-road use with equipment required by G.S. 20-121.1(2a), and must meet the following statutory requirements:
The following is required for a customer to title and license a modified utility vehicle in North Carolina.
Additionally, these vehicles are only to be operated on streets and highways where the posted speed limit is 55mph or less; provided, a modified utility vehicle may not be operated on any street or highway having four or more travel lanes unless the posted speed limit is 35 miles per hour or less.

My name is Kyle Wrightenberry and I’m the owner/operator of Unseen Pass (my story).
I’m spearheading the effort to lobby the North Carolina General Assembly to make SXS/UTVs legalized for road use and become the next state to do so. I’m open to and would appreciate help from fellow SXS/UTV owners in NC.

In late August, I was issued two statues by a representative from the DMV basically stating that (1) NC doesn’t honor my South Dakota registered four-wheeled motorcycles as reciprocal vehicles between the two states, pretty much still considering them UTVs vs what the other states classify them as and (2) if I’m to rent them, my renters are subject to incur a $100 rental infraction.
